Ignite Cotreat 2026 Service Agreement and Cancelation Policy

Service Agreement

PARTICIPANT LIABILITY STATEMENT

I, the participant, desire to participate in the Ignite Cotreat (the “Cotreat”) at Onze Xpuha Sanctuary, located at 77734 playa del carmen, Quintana Roo, Mexico (the “Premises”), including, without limitation, by traveling to te Premises, entering the Premises and observing, participating or otherwise being involved in the Cotreat. In consideration of being permitted to enter the Premises and participate in the Cotreat, and in recognition of the Company’s reliance hereon, I hereby agree to following the terms of this Participant Liability Statement (the “Statement”): 

 

  • Release from Liability.  I fully and forever release and discharge Becca Kristine Inc. and all others involved in the Cotreat (whether volunteers, employees or otherwise) and its and their respective affiliates, directors, officers, shareholders, employees, agents and insurers and all others involved in the Cotreat (collectively, the “Sponsor”) from any and all injuries (including death), losses, damages, claims, demands, lawsuits, expenses and any other liability of any kind, of or to me, my property or any other person, directly or indirectly arising out of or in connection with my participation in the Cotreat. I recognize, intend and understand that this release is binding on my heirs, executors, administrators and assignees.

 

I understand that by clicking “Confirm my purchase”, I am waiving any and all claims, of any kind arising out of or attributable to my participation in the Cotreat, including those claims that may be unknown to me, or which I do not suspect to exist at this time. WITH THE INTENTION OF WAIVING ALL UNKNOWN AND UNSUSPECTED CLAIMS, I HEREBY EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS I MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH READS AS FOLLOWS: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

    1. Assumption of Risk.  I am aware and understand that participating in the Cotreat may involve inherent dangers and may expose me to a variety of foreseen and unforeseen hazards and risks. I fully understand that such dangers, hazards and risks may be caused by my own actions or inactions, the actions or inactions of others participating in the Cotreat or the Sponsor, or the conditions in which the Cotreat takes place. Furthermore, I acknowledge and accept that there may be other dangers or risks either not known to me or not readily foreseeable at this time. I acknowledge that I should not participate in the Cotreat unless I am medically and physically able to do so. I understand and have considered such dangers and risks involved in the Cotreat, and I voluntarily and freely choose to assume these dangers and risks, including any and all risk of injury, harm, or loss that I may incur as a result of my participation in the Cotreat.
    2. Disclaimer. I am aware and understand that the Sponsor is not an agent, publicist, accountant, financial planner, lawyer, therapist, or any other licensed or registered professional, and that the Sponsor’s advice or guidance provided during the Cotreat is not a substitute for legal, financial or other professional advice. The Sponsor cannot and does not guarantee or predict that I will achieve any particular result or outcome as a result of participating in the Cotreat, including with respect to finances, earnings or income, or physical, mental, emotional, spiritual or health benefits. Individual results may vary based upon numerous factors, including without limitation, the individual’s skills, background, experience, expertise, resources, effort, motivation, commitment and actions taken.
    3. Covenant Not to Sue.  I will not initiate any claim, lawsuit, court action or other legal proceeding or demand against Sponsor, nor join or assist in the prosecution of any claim for money or other damages that anyone may have, on account of injuries, losses or damages sustained by me or other parties or by my or such other parties’ property in connection with my participation in the Cotreat, and I hereby waive any right I may have to do so. This means that I cannot sue to hold Sponsor responsible for any injury, loss or damage sustained by me or other parties or by my or such other parties’ property in connection with the Cotreat, even if it is due to an action or omission of Sponsor. I waive my insurers’ right to make a claim against Sponsor based on payments by insurers to me or on my behalf for any reason. 
    4. Medical Expenses.  In the event of an illness, accident, injury or medical emergency arising during or in connection with the Cotreat, I hereby authorize and give my consent to Sponsor to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully and solely responsible for payment of any and all medical services and treatment rendered to me including, but not limited to, medical transport, medications, treatment and hospitalization.
    5. Indemnification.  I shall defend, indemnify, and hold harmless the Sponsor against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees and the costs of enforcing any right to indemnification under this Statement, and the cost of pursuing any insurance providers arising out of or resulting from any claim of a third party related to my actions and/or omissions while participating in the Cotreat, including any claims arising out of my own negligence or the ordinary negligence of the Sponsor.
    6. Representations.  As a material condition to my being permitted to participate in the Cotreat, I certify that I am physically fit and do not have any medical or other conditions that would impair my ability to participate in the Cotreat.
    7. Covenants.  I will follow any and all instructions, recommendations and cautions of Sponsor at all times during the Cotreat. I will comply with all Law while participating in the Cotreat. If at any time I believe the conditions to be unsafe or that I am no longer in proper condition to participate in the Cotreat, I will immediately cease further participation in the Cotreat.

 

  • Publicity.  I grant Sponsor, without any limitations whatsoever, permission to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording in connection with the Cotreat for any purpose, including but not limited to advertising, publicity and promotion of the Sponsor and its business, products and services, without further compensation or permission. 

 

  1. Miscellaneous.  This Statement shall be binding upon and enforceable against me, my personal representatives, spouse, assigns, heirs and next of kin without limitation. It is my desire and intent that the words, terms, provisions, covenants and remedies contained herein shall be enforceable to the fullest extent permitted by Law. If any portion of this Statement is held invalid, the remainder shall not be affected and shall continue in full legal force and effect. This Statement constitutes the entire agreement between Sponsor and me and supersedes any previous or contemporaneous discussions or agreements between Sponsor and me with respect to the matters herein. Any claim or cause of action arising under this Statement shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction). Any claim or cause of action arising under this Statement may be brought only in the federal and state courts located in Sacramento, California and I hereby consent to the exclusive jurisdiction of such courts.

BY CLICKING “CONFIRM MY PURCHASE”, I ACKNOWLEDGE THAT I HAVE READ, FULLY UNDERSTAND ITS TERMS AND AGREED TO THE ABOVE RELEASE AND WAIVER, ASSUMPTION OF RISK, COVENANT NOT TO SUE AND INDEMNITY.

Cancelation Policy

By clicking “Complete my purchase”, you acknowledge and agree that any and all payments you make to purchase this ticket are final and non-refundable. If, after completing your purchase of your ticket, you notify us in writing (email being sufficient) that you will not attend Ignite Cotreat, we may choose to (but are not required to) take reasonable steps to find someone who is willing to purchase your ticket for at least the same amount you have paid for your ticket. In the event we find someone to purchase your ticket for such amount, after we receive payment in full from such person purchasing your ticket, then we will refund you 75% of the total amount you paid for your ticket to the original form of payment.
